1. Scope and Acceptance

These Terms of Service govern your access to and use of the Hermeno mobile application, related backend services, website, and associated features.

By creating an account or using Hermeno, you agree to these Terms. If you do not agree, you should not use the service.

Additional documents, including the Privacy Policy and AI Notice, form part of the overall documentation governing your use of Hermeno.

2. Eligibility and Accounts

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

• provide accurate registration information;
• keep your account information up to date;
• protect your login credentials;
• notify Hermeno if you suspect unauthorized access to your account.

You are responsible for activities performed through your account.

3. Permitted Use

Hermeno may be used for personal language-learning purposes, including:

• creating vocabulary;
• reviewing learning material;
• using AI-assisted learning features;
• participating in quizzes;
• managing your learning progress.

You agree to use the service only in accordance with applicable laws and these Terms.

4. Prohibited Use

You must not:

• attempt to gain unauthorized access to Hermeno systems;
• interfere with the operation or security of the service;
• upload unlawful, malicious, or harmful content;
• misuse AI functionality;
• use automated systems to abuse the service;
• attempt to reverse engineer the application where prohibited by law.

Hermeno may suspend or terminate accounts that violate these Terms.

5. User Content and Learning Data

You retain ownership of content that you create or upload while using Hermeno.

By submitting content to Hermeno, you grant Hermeno the limited rights necessary to process, store, and display that content solely for operating the service.

You are responsible for ensuring that any content you upload does not infringe the rights of third parties or violate applicable law.

6. Artificial Intelligence

Hermeno offers artificial intelligence features to support language learning.

AI-generated translations, explanations, vocabulary suggestions, example sentences, OCR results, and quizzes are provided solely as educational assistance.

AI output may occasionally contain inaccuracies, omissions, or outdated information. Users remain responsible for reviewing AI-generated content before relying on it.

Hermeno may reuse previously generated AI responses through a shared cache to improve response times and reduce repeated processing.

7. Availability and Changes

Hermeno is continuously developed and improved.

Features may be added, modified, temporarily unavailable, or removed without prior notice where reasonably necessary for maintenance, security, legal compliance, or product improvement.

Although Hermeno aims for high availability, uninterrupted operation cannot be guaranteed.

8. Intellectual Property

Unless otherwise stated, the Hermeno application, software, design, branding, documentation, and related materials are protected by applicable intellectual property laws.

These Terms do not transfer ownership of Hermeno or its intellectual property to users.

Users retain ownership of content they create and upload while using the application.

9. Account Suspension and Termination

Hermeno may suspend or terminate accounts that:

• violate these Terms;
• threaten the security or stability of the service;
• misuse AI functionality;
• attempt unauthorized access;
• engage in unlawful activities through the platform.

Where appropriate, reasonable efforts may be made to notify affected users before permanent termination.

10. Account Deletion

Users may request deletion of their account through the application.

Deletion requests are processed according to Hermeno's account-deletion procedures.

Some technical records or backup copies may remain temporarily where required for security, disaster recovery, or legal obligations.

11. Disclaimer

Hermeno is provided as an educational language-learning platform.

While reasonable efforts are made to provide accurate and reliable functionality, Hermeno is provided on an "as available" basis.

AI-generated content, translations, explanations, OCR results, quizzes, and other educational material may contain inaccuracies or omissions and should not be considered professional advice.

Users remain responsible for verifying information before relying upon it.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Hermeno shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the service.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

These limitations apply only to the extent permitted by the laws governing the user's jurisdiction.

13. Future Paid Features

The current MVP is provided without subscription fees.

Hermeno may introduce optional paid features, subscriptions, or premium services in the future.

If paid services are introduced, pricing, billing, cancellation rights, and any additional terms will be presented before purchase and, where applicable, governed by separate commercial terms.

14. Governing Law

These Terms shall be governed by the applicable laws of the Federal Republic of Germany, unless mandatory consumer-protection laws in the user's country of residence provide otherwise.

If individual provisions of these Terms are found to be invalid or unenforceable, the remaining provisions shall remain unaffected to the extent permitted by law.
